These Terms & Conditions ("Terms") govern your use of the Zevorin Studios website and any motion design, animation, video editing, or related creative services (the "Services") provided by Zevorin Studios ("we," "us," "our"). By engaging our Services or using our website, you ("Client," "you") agree to these Terms.
1. Our services
Zevorin Studios provides custom motion design and video production services, including but not limited to: discovery and creative strategy, moodboarding and storyboarding, editing, color grading, animation, and sound design. The specific scope, deliverables, timeline, and price for each project are agreed in a separate proposal, quote, or statement of work ("Project Agreement"), which forms part of these Terms.
2. The project process
Unless otherwise agreed, projects generally follow five stages: (1) a discovery call to understand your goals, (2) moodboard and storyboard development, (3) editing and color grading, (4) animation and sound design, and (5) final delivery. Each stage may require your written approval before we proceed to the next. Delays in providing feedback, assets, or approvals may extend the delivery timeline accordingly.
3. Client responsibilities
You agree to:
- Provide accurate project requirements, brand assets, footage, and any other materials needed to complete the work.
- Respond to requests for feedback or approval within a reasonable time (typically 5 business days, unless otherwise agreed).
- Ensure you own or have the right to use any assets, footage, music, likenesses, or trademarks you provide to us.
- Make payments according to the agreed schedule.
4. Fees and payment
- Project fees are set out in the Project Agreement. Unless otherwise stated, a non-refundable deposit (typically 50%) is due before work begins, with the balance due upon final delivery or according to agreed milestones.
- Late payments may result in paused work and may accrue a late fee of up to 1.5% per month or the maximum permitted by law.
- All fees are exclusive of applicable taxes unless stated otherwise.
5. Revisions
Each project includes a set number of revision rounds as specified in your Project Agreement. Additional revision requests, or requests that materially change the agreed scope, may be billed at our standard hourly rate or as a separate change order.
6. Intellectual property and licensing
- Upon full and final payment, you receive full ownership and license to use the final approved deliverables for the purposes agreed in your Project Agreement.
- We retain ownership of any pre-existing tools, templates, project files, source files, and unused concepts created during the project, unless otherwise agreed in writing.
- We reserve the right to display completed work in our portfolio, website, and marketing materials, unless you request confidentiality in writing and we agree to it.
- You are responsible for ensuring any third-party assets (stock footage, music, fonts) you provide are properly licensed for the intended use.
7. Confidentiality
We treat project briefs, unreleased products, and business information shared with us as confidential, and will not disclose them to third parties without your consent, except as required by law. A separate mutual NDA can be signed on request.
8. Cancellations and delays
If you cancel a project after work has begun, fees for work already completed remain payable, and any deposit paid is non-refundable (see our Refund Policy for details). If a project is inactive for more than 60 days due to lack of client response, we reserve the right to close the project; resuming it later may require a new agreement.
9. Limitation of liability
To the maximum extent permitted by law, Zevorin Studios' total liability for any claim relating to the Services is limited to the amount you paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.
10. Force majeure
We are not liable for delays or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, internet or platform outages, or other events of force majeure.
11. Termination
Either party may terminate an ongoing Project Agreement with written notice if the other party materially breaches these Terms and fails to remedy the breach within 14 days of notice. Fees for work completed up to the termination date remain payable.
12. Governing law
These Terms are governed by the laws of [Your Country/State], without regard to conflict of law principles. Any disputes will be resolved in the courts of [Your Jurisdiction], unless otherwise required by applicable consumer protection law.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of our Services after changes take effect constitutes acceptance of the new Terms.
